1.1 Just Jeans Pty Ltd A.C.N 004 890 037 ("Just Jeans") runs a loyalty program known as JUST-SHOP ("Program"). These terms and conditions form the basis of the Program and govern the use of the JUST-SHOP Card ("Card").
1.2 By applying for or using the Card you:
1.2.1 agree to be bound by these terms and conditions and any variations to them;
1.2.2 agree to participate in the Program; and
1.2.3 agree to receive information and promotions via the Card, e-mail and SMS (where you have provided such information).
2.1 To participate in the Program, you will need to be issued with a Card.
2.2 To obtain a Card you will need to legibly complete and sign the enrolment form, hand it to a Participating Just Jeans Store and pay a $5 administration fee. This $5 fee is not refundable.
2.3 If you have been a member of the "Do You Belong? Program", Just Jeans (in its sole discretion), may issue you with a Card without requiring an enrolment form to be completed. If you use the Card then you will be bound by these terms and conditions.
2.4 Employees of Just Jeans, its related companies, its data processing and advertising agents and Visible Results Australia Pty Ltd are not eligible for a Card.
2.5 Applicants can only be eligible for one Card each and the issuing of a Card and disqualifying of a Card, Cardholder or participant in the Program are at Just Jeans' sole discretion. The Cardholder's Card will only have points updated if presented when making purchases at a Participating Just Jeans Store.
3.1 The Card is for personal use only. It must not be used by or for a corporation or business and is not transferable. Just Jeans is entitled to regard the person presenting the Card as the Cardholder.
3.2 It is the Cardholder's responsibility to keep the Card safe and Just Jeans is not responsible for points not utilised by the Cardholder according to these terms and conditions or for stolen, lost or damaged Cards or the failure of a Cardholder to provide the Card at the time of making a purchase.
3.3 If a Card is lost or damaged, you may apply for a replacement Card by logging onto www.justjeans.com.au or by calling the JUST-SHOP Enquiry line (see clause 10). Just Jeans will use its best endeavours to transfer any points on your old Card onto the new Card. Just Jeans may charge you $5 for a replacement Card to cover the costs for administration and handling. This $5 fee is not refundable.
3.4 The Card and vouchers in relation to the Program at all times remain the property of Just Jeans.
3.5 Your points will be updated at the time your Card is used.
3.6 For your Card to remain valid, it will need to be "Active". For the Card to remain "Active", you must present your Card and make a minimum purchase of $5 within twelve months of each anniversary of the date you became a member and if you do not, your membership will be considered in-active and your Card will be cancelled.
3.7 The Card must be presented at the time of making a purchase at a Participating Just Jeans store for Voucher Points and Status Points to be awarded. Your Card must be Active, not tampered with and undamaged.
3.8 You are responsible for checking your Card after it is used in each transaction to ensure the details (including the number of points) are correct. It is your responsibility as Cardholder to provide Just Jeans with any changes to your details.
3.9 The Card cannot be used in conjunction with any discounts offered to staff of Bunnings and the Defence Force.
4.1 Subject to clause 12.3, for every dollar you, as the Cardholder, spend to purchase merchandise (rounded to the nearest whole dollar) at a Participating Just Jeans Store, 1 voucher point is awarded to your Card ("Voucher Point").
4.2 For your Voucher Points to remain valid, you will need to be an "Active Member". To remain as an Active Member you must present your Card and make a minimum purchase of $5 within twelve months of each anniversary of the date you became a member.
5.1 A $10 JUST-SHOP gift voucher will be awarded for every 200 Voucher Points you accumulate ("JUST-SHOP Gift Voucher").
5.2 When a JUST-SHOP Gift Voucher is provided, the corresponding number of awarded Voucher Points are deducted from your Card.
5.3 A JUST-SHOP Gift Voucher issued under the Program:
5.3.1 Is valid for use at Participating Just Jeans Stores for three months from the date of issue.
5.3.2 Can only be claimed at a Participating Just Jeans Store on presentation of your Card.
5.3.3 Is not transferable, not redeemable for cash and is not a negotiable instrument and can only be redeemed by the Cardholder to whom it was issued.
5.3.4 Can only be redeemed on a purchase of $15 or more.
5.3.5 Can be used with other JUST-SHOP Gift Vouchers and/ or Just Jeans gift vouchers provided that each JUST-SHOP Gift Voucher can only be redeemed for at least each $15 of the purchase price (for example, if you use two JUST-SHOP Gift Vouchers, the purchase must be at least $30).
5.3.6 Will not be replaced if lost, stolen or defaced to the extent it is illegible.
5.3.7 Cannot be used in conjunction with discounts offered to staff of Bunnings and the Defence Force.
6.1 Subject to clause 12.3, for every dollar you, as the Cardholder, spend to purchase merchandise (rounded to the nearest whole dollar) at a Participating Just Jeans Store, 1 status point will be awarded to your card ("Status Point"). Status Points are used to assess your status level and privileges according to the status level scale (shown below).

6.2 Your Status Level is determined based on the number of Status Points you earn during a twelve month period calculated from each anniversary of the date you became a member. The Status Points do not accumulate beyond the relevant twelve month period. Once you achieve a Status Level, you will remain in that level until you accumulate the Status Points needed for a higher Status Level (for example, if you are in silver, then to move to gold, you will need to achieve a minimum of 3000 Status Points within a twelve month period calculated from the anniversary of the date you became a member. If you do not achieve a minimum of 3000 Status points within that period, you will remain in silver and your Status Points will be removed).
6.3 For your Status Level to remain valid, you will need to be an "Active Member". To remain an Active Member you must present your Card and make a minimum purchase of $5 within twelve months of each anniversary of the date you became a member.
7.1 As a Cardholder you may have the chance to win prizes and receive offers when presenting your Card at a Participating Just Jeans Store. Competitions and other offers will be subject to their own terms and conditions which will be available in store and at www.justjeans.com.au. Competitions and offers may limit certain Cardholders from entering and/ or claiming a prize or offer.
7.2 Your Card may also inform you of offers, promotions or benefits from time to time including from third parties, which will be subject to their own terms and conditions. Just Jeans and the Card act as conveyers of any information from third parties which Just Jeans expects to be of benefit to you and Just Jeans does not take any responsibility for the third party, their offer, promotion or benefit.
8.1 If you no longer wish to participate in the Program or receive the information or offerings, you can withdraw from the Program by notifying Just Jeans in writing and returning the Card to the Customer Service Assistant at Just Jeans Pty Ltd P.O. Box 2196 Richmond South Victoria 3121.
8.2 Just Jeans reserves the right to vary these participating terms and conditions at any time and to suspend or cancel the Program and the Card at any time upon reasonable notice.
Any notice Just Jeans may wish to provide to the Cardholder shall be regarded as notified to the Cardholder if sent by prepaid post or e-mail addressed to the Cardholder's address provided in the enrolment form or as otherwise notified in writing by you to Just Jeans.

11.2 The purpose for Just Jeans collecting your personal information is for you to participate in the Program. This privacy statement and these terms and conditions form part of each other. For the purposes of operating the Program, Just Jeans provides your personal information to Visible Results Australia Pty Ltd that provides the technology and related services for the Program. As Visible Results Australia Pty Ltd operates in New Zealand (as well as in Australia), it may hold your personal information in New Zealand. If you do not provide us with information required in the enrolment form you may not be eligible to obtain a Card or participate in the Program. If you require a replacement card, Just Jeans may require you to fill out a form and provide such information that Just Jeans reasonably requires. Just Jeans may require prize winners to provide evidence of identity and sign such acknowledgement of receipt as Just Jeans reasonably requires. Please note that the terms and conditions of competitions and other offers will be subject to their own terms and conditions, which will set out how your personal information may be used. We provide your personal information in the case of prize winners to the prize provider and may publish the names and suburbs of winners.
12.1 Participating Stores are all Just Jeans stores in Australia. Just Jeans Online is not part of the Program. Points will not be awarded for any purchases made on Just Jeans Online. The Card cannot be used when making purchases on Just Jeans Online nor can JUST-SHOP Gift Vouchers be used for purchases made on Just Jeans Online.
12.2 A copy of the current terms and conditions can be viewed in Participating Stores, at Just Jeans' registered office at 658 Church Street, Richmond or at www.justjeans.com.au.
12.3 Voucher Points and Status Points will not be awarded for any amount spent on alterations of merchandise, for the initial membership fee, for any administrative costs if your Card is replaced nor for any amount spent on merchandise provided by a third party collecting for charitable purposes.
12.4 Voucher Points and Status Points for purchases made by layby will be awarded on final payment upon presentation of your Card.
12.5 Just Jeans will not be responsible for lost, stolen, illegible or damaged vouchers.
12.6 The Card and the technology utilised by the Program depend on a third party or parties and Just Jeans is not responsible for computer or technological errors or failures, or for fraud.
12.7 Voucher Points, Status Points, JUST-SHOP Gift Vouchers and other vouchers issued under the Program are not transferable, are not redeemable for cash and are not negotiable instruments.
12.8 Any Voucher Points or Status Points credited in error or any points relating to a transaction which is cancelled or reversed or where a refund is given, will be deducted from the Card.
12.9 Third parties involved in the program do not have any authority, express or implied, to make any representation, warranty or statement on behalf of Just Jeans and Just Jeans accepts no liability in respect of such representations, warranties or statements.
