Terms & Conditions

1. Information on how to enter forms part of these Terms and Conditions. Entry into the competition constitutes acceptance of these Terms and Conditions and an acknowledgement that this is part of the JUST SHOP loyalty program; which is governed by the JUST SHOP Membership Terms and Conditions (available at Participating Just Jeans Stores and at www.justshop.com.au).

2. To be eligible for entry into this promotion, a person must be a resident of Australia, aged 18 years or over and a valid JUST SHOP Member (“Eligible Entrant”). Employees of Just Jeans and/or their related entities and agencies are not eligible to enter this promotion.

3. This promotion commences at 9.00am (AEDST) Wednesday 20th January 2010 and closes at 11.59pm (AEDST) Tuesday 16th February 2010 ("Promotion Period"). Entry can be made via Internet only. Any costs associated with accessing the promotional website remain the responsibility of each entrant and are dependent on the Internet service provider used. Any contact details entered incorrectly on the website shall be deemed invalid and will result in an ineligible entry.

4. An Eligible Entrant who makes a qualifying purchase at a participating Just Jeans store during the Promotional Period and presents their JUST SHOP card, or identifies themselves as a JUST SHOP Member at the time of making the purchase will be invited to enter the Major Prize Draw.

5. An Eligible Entrant can enter the Major Prize Draw during the Promotion Period (in respect to Condition 12) by logging onto www.justshop.com.au and completing the entry form in the full manner required providing their own name, contact number, email address, receipt number, and JUST SHOP Membership card number.

Note: Eligible Entrants will receive a receipt at the time of their purchase that will feature a Unique Receipt Number. Membership numbers can be found on the back of their membership cards.

6. Participating Just Jeans Stores refer to all Just Jeans stores in Australia excluding Just Jeans online, Just Jeans Swan Hill and all Just Jeans Factory Outlets.

7. Incomplete, ineligible or incomprehensible entries will be deemed invalid. No responsibility will be taken for lost, late or misdirected entries. Entries must be received by the Promoter during the Promotion Period. Entries will be deemed to be accepted at the time of receipt into the promotional database and not at the time of transmission.

8. Any form of automated entry using the Internet or any other device or software is invalid.

9. For all entries a notification page will advise consumers their entry has been successfully received. If an entry is not successful because it is not in the required format, fields are incomplete or ineligible a “try again” message will be sent to the entrant. The “try again” message will prompt the entrant to check their entry form and resubmit their entry in the required form.

10. All entries must be received by Just Jeans Pty Ltd during the Promotion Period. One entry per receipt number is permitted. Entrants may be required to present proof for all entries made. Proof of entries include providing the Promoter with their purchase receipt within the required time frame set out by the Promoter

11. Entrants can only enter in their own name. The Promoter reserves the right to request the winners to produce (within the requested time) appropriate photo identification or other documentation (to the Promoter’s satisfaction, at its sole discretion) in order to confirm the winners’ identity, age, residential address, eligibility to enter and claim a prize, that the entrant obtained the bill payer’s consent to enter before submitting their entry/entries (if applicable) and any information submitted by the winners in entering the promotion before issuing a prize. If the documentation required by the Promoter is not received by the Promoter (or its nominated agent) or the winning entry has not been verified or validated to the Promoter’s satisfaction within the time requested, the winner’s entry will become invalid. In the event that a winner cannot provide suitable proof, the winner will forfeit the prize in whole and no substitute will be offered. The prizes will only be awarded following any winner validation and verification that the Promoter requires in its sole discretion.

12. Any Eligible Entrant who submits an entry in accordance with Condition 5 will be given the following number of entries depending upon his or her status level at the time his or her purchase receipt is issued: Silver status level members will be given one entry, Gold status level members will be given two entries and Platinum status level members will be given three entries. For an explanation of the status levels, please refer to the JUST SHOP Membership Terms and Conditions. Every entry has an equal chance of winning.

13. The Major Prize draw will take place at 11.00am (AEDST) on Friday 19th February 2010 at Oxygen Interactive Marketing, Level 1, 16 Palmer Parade VIC 3121. The winner will be notified by telephone and in writing and their name and postcode published in The Australian newspaper on Friday 26th February 2010.

14. Major Prize Draw: The first valid entry randomly drawn will win a Territory Discovery Outback Holiday package valued up to $7123 (depending on point of departure of winner). Prize includes return airfares for two adults departing from the winners nearest state of residence to Darwin, return airport transfers in Darwin, two nights twin share accommodation in a Deluxe Ocean View room at the SkyCity Darwin (arrival and departure), Darwin Harbour Sunset Çruise, Private Meet & Greet and a 5 day touring package - Itinerary is as follows:

Day 1: Depart Darwin accommodation 7-7:15am for Kakadu National Park. Enroute visit the Adelaide River Wetlands, Fogg Dam Conservation Reserve and the Bark Hut Inn for a refreshment stop before entering Kakadu. Travel along the old Jim Jim Road stopping for a quick look at White Lily Billabong before arriving at Maguk (Barramundi Gorge). Here we take a scenic 1-km walk along the edge of Barramundi Creek before arriving at the base of Barramundie Falls for a swim in the large plunge pool below. A large array of aquatic life is present at Maguk. Depart mid afternoon for Nourlangie Rock where the remainder of the afternoon viewing one of Kakadu's oldest Aboriginal Rock Art and occupation sites. Head for Nawalandja lookout. A short climb takes us up the sloping sandstone to provide views of the sun setting across Anbangbang billabong, Nourlangie Rock and the Arnhem Land Escarpment. Depart after sunset for Jabiru for your overnight accommodation. (L,D)

Day 2: After breakfast we travel from Jabiru to the Northern region of Kakadu National Park to Cahill's Crossing on the East Alligator River and enter Arnhem Land. A 15km scenic drive to Gunbalanya Aboriginal community provides some of the best driving views in the Top End. Upon arrival at Gunbalanya we will visit the Injalak arts and crafts centre. Here you have the opportunity to meet and watch traditional local artists in action before departing with our Aboriginal guide to be shown around the Injalak Hill Art sites. After viewing some Aboriginal Art sites, we leave Injalak and journey onto the Cobourg Peninsula. The drive takes approximately 3-4 hours with stops along the way. Upon arrival at Cobourg we will head straight for Venture North's permanent coastal camp to settle in and enjoy the sunset. (B,L,D)

Day 3: This morning is spent exploring the Cobourg Marine Park by boat enroute to the Victoria settlement ruins. The Victoria Settlement was established between 1838 - 1849 by the British as one of the first settlements in Northern Australia. The stone ruins are still standing on the shoreline of Port Essington and serve as a reminder of the harshness early settlers faced. Cobourg is also abundant in some amazing marine life such as Dugong, Dolphins, 6 species of Marine Turtles, Crocodiles, Stingrays and plenty of fish. All without the crowds. Return to camp to explore more of the surrounding area before sitting back to enjoy sunset and a fresh BBQ dinner. (B,L,D)

Day 4: Today we explore the eastern side of the Park this time by 4WD. Cobourg is home to the first RAMSAR wetlands (wetlands of international importance) in Australia with freshwater paperbark swamps and billabongs 100m from the coastline. Continue on via the northern beaches, commonly used as turtle nesting areas and covered in a wide range of shells. This afternoon visit the parks' cultural and information centre before heading back to camp. (B,L,D)

Day 5: This morning depart Cobourg and head back to Kakadu National Park. After lunch you have the option of joining the Guluyambi Cultural Cruise on the East Alligator River (additional cost) or alternatively visit Ubirr Rock where we spend time viewing some Aboriginal Rock Art and enjoying spectacular views of the surrounding wetlands and stone country from the top of Ubirr. Depart Ubirr/East Alligator returning to Darwin via the Arnhemland highway. Enroute to Darwin stop and visit the Mamukala Wetlands, which at times is a haven for thousands of Magpie Geese as well as many other species of native birds and reptiles. Arrive in Darwin approximately 7:00pm. (B,L).

15. Bookings must be made at least 30 days prior to travel and all bookings must be confirmed no later than 31 May 2010 with all travel completed by 30 November 2010. Tours depart Darwin on Monday & Wednesday. Black out periods may apply and can be checked at the time of booking. Bookings must be made direct with Territory Discoveries and cannot be changed once the booking has been made. Unused portions of the prize are forfeited and cannot be redeemed by for cash.

16. The winner (and their companion) is responsible for all other expenses including spending money, meals (unless specified), drinks, transfers (unless specified), laundry charges, activities (unless specified), incidentals, energy surcharges, gratuities, services charges, travel insurance and all other ancillary costs. Travel insurance is highly recommended to protect against the additional costs incurred in the event of unforeseen circumstances. Personal baggage is limited to one overnight bag and a day pack. Tour not suitable for children under 5 years. Optional Guluyambi Cruise not included.

17. The prize winner will be required to sign a prize winner agreement between Territory Discoveries and the prize winner.

18. Air tickets are available on the regular scheduled services of each airline and are subject to seasonal embargos. Flight itinerary may have to be adjusted depending on the airlines departure city and their current flight schedule. Frequent Flyer points are not available from any airline.

19. A credit card imprint or cash deposit may be required from the winner at check-in to the hotel, for all incidental charges.

20. It is the traveller’s personal responsibility to ensure that they have valid documentation, including but not limited to valid passports and visas, which meet the requirements of immigration and other government authorities at every destination. Any fines, penalties, payments or expenditures incurred as a result of such documents not meeting the requirements of those authorities will be the sole responsibility of the traveller/s.

21. Just Jeans Group, Oxygen Interactive Pty Ltd and any other associated parties make no representation as to the safety, conditions or other issues that may exist at any destination. International travel advice can be obtained from various sources, including government, local consular offices and the web site of the Australian Department of Foreign Affairs and Trade.

22. By entering this competition, entrants accept and acknowledge full responsibility for their decision to participate in this prize should they be chosen as winners. The winners release the Promoter and other organisers, their related bodies corporate, affiliates, officers, agents and employees, from all liabilities, loss and damage of any kind arising at any time out of or in connection with the acceptance of, and participation in, the prize. Without limiting the foregoing, the released parties not be liable for any injury, sickness or death, property loss or damage or other direct or indirect loss or damage of any kind, howsoever sustained or incurred, in connection with or arising out of the prize or any other aspect of the prize. The winner acknowledges that they have been warned that there is a possibility of an accident causing injury, death or property damage in accepting the prize.

23. In the event that for any reason whatsoever a winner does not take the prize at the time stipulated by the Promoter then the prize will be forfeited by the winner and cash will not be awarded in lieu of that element of the prize. The prize is non-transferable and non-redeemable for cash. Any attempt to resell or auction all or any part of this prize will result in an immediate cancellation of the prize. The prize elements may be terminated without notice if these Terms and Conditions are not complied with.

24. It is a condition of accepting the prize that the winner may be required to sign a legal release in a form determined by the Promoter in its absolute discretion.

25. If the Major Prize is unclaimed or the winning entrant is unable to satisfy these Terms and Conditions by 5:00pm AEST on Tuesday 8th June 2010, then a second chance prize draw will take place to distribute the prize at 11.00am AEST on Wednesday 9th June 2010 at the same address as the original prize draw. All VALID MEMBERS who made a purchase during the Promotional Period will be entered into the second chance prize draw. In the event of a second chance prize draw, the winner will be notified by mail and by telephone and their name and postcode published in The Australian newspaper on Friday 11th June 2010.

26. The Promoter is not responsible for any problems or technical malfunction of any computer on-line systems, servers or providers, computer equipment, software, technical problems or traffic congestion on the Internet or at any web site, or any combination thereof, including any injury or damage to participants or any other person’s computer related to or resulting from participation in or down-loading any materials in this promotion.

27. Caution: any attempt to cause malicious damage or interference with the normal functioning of the Website application or to otherwise undermine the legitimate operation of this promotion may be a violation of criminal and civil laws and should such an attempt be made, whether successful or not, the Promoter reserves the right to seek damages to the fullest extent permitted by law. If the Promoter suffers loss or incurs any costs in connection with any breach of these Conditions of Entry or any other legal obligation by an entrant, the entrant agrees to indemnify the Promoter for those losses, damages and costs.

28. If for any reason this promotion is not capable of running as planned because of infection by computer virus, bugs, tampering, unauthorised intervention, technical failures or any other causes beyond the reasonable control of the Promoter which corrupt or affect the administration, security, fairness, integrity or proper conduct of this promotion, the Promoter reserves the right in its sole discretion to cancel, terminate, modify or suspend the promotion, subject to any written directions under State or Territory legislation.

29. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.

30. Prize values are correct at the time of printing and are subject to change without notice. Just Jeans Pty Ltd accepts no responsibility for changes to prize values. All prizes are not exchangeable, transferable or redeemable for cash or other goods or services. Any tax implications for Eligible Persons, which may arise from this promotion are the responsibility of the Eligible Persons, and independent advice should be sought.

31. The Promoter reserves the right to request winners to provide proof of identity, proof of residency at the nominated prize delivery address and/or proof of entry validity (including phone bill or store receipt for purchase requirement) in order to claim a prize. Proof of identification, residency and entry considered suitable for verification is at the discretion of the Promoter.

32. The winners agree to participate in all reasonable promoted activities in relation to the promotion as requested by the Promoter and its agents and sign any release document provided by the Promoter, in its absolute discretion. Entrants consent to the Promoter using the entrant's name, likeness, image and/or voice in the event they are a winner of a draw (including photograph, film and/or recording of the same) in any media for an unlimited period of time without remuneration or compensation for the purpose of promoting, publicising or marketing this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.

33. In conducting this promotion Just Jeans Pty Ltd:

34. All entries and any copyright subsisting in the entries become and remain the property of the Promoter. The Promoter collects personal information about entrants to include entrants in the promotion and where appropriate award prizes. If the personal information requested is not provided, the entrant may not participate in the promotion. By participating in the promotion, each entrant also acknowledges that a further primary purpose for collection of entrants’ personal information by the Promoter is to enable the Promoter to use the information to assist the Promoter in improving goods and services and to contact entrants in the future with information on special offers or provide entrants with marketing materials via any medium including mail, telephone and commercial electronic messages (SMS (Short Message Service), MMS (Multimedia Message Service), IM (Instant Messaging) and email) or any other form of electronic, emerging, digital or conventional communications channel whether existing now or in the future. The Promoter may share information with its Australian related companies or promotional partners who may contact entrants with special offers in this way. By entering the promotion, each entrant agrees that the Promoter may use entrants’ personal information in this manner. Each entrant also agrees that the Promoter may publish or cause to be published the winner’s name and locality in any media as required under the relevant lottery legislation. Entrants can also gain access to, update or correct any personal information by contacting the Promoter at the address below. All personal information will be stored at the office of the Promoter.

35. Just Jeans and its respective related bodies corporate, officers, employees and agents will not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss), or for personal injury suffered or sustained in connection with this competition, the promotion of this competition or the use of the prize, except for any liability that cannot be excluded by law.
